Primary Battery Safety Regulations - Malaysia


When we searched the European Union Rapex site we found (almost) no recalls of primary batteries. Recalls are primarily for battery chargers and battery packs for lap tops. These posed electric shock hazards to consumers and were recalled.

Why refer to EU RAPEX? Well they have among the most sophisticated rapid alert system - relatively speaking! Easily 'searchable' unlike our own myStandard.kpdnkk.

Recently KPDNKK sanctioned the primary battery (safety) regulation and all primary batteries must bear the MCmark (safety mark). The onus is on the businesses to ensure that the batteries placed in the market are safe and that safety incidents and issues must be reported to the Ministry "within the specified time frame of the corrective action plan that has or will be taken". 

What is the specified time frame is anyone's guess.

Coming back to to primary battery safety. While the regulation is welcomed but we are in the opinion it is rather misplaced. Secondary batteries such as the ones in your laptop and mobile phones have posed more risk to consumers than primary batteries. 

Primary batteries (almost all batteries) pose significant environmental risk! But safety risks to consumers during the useful life of the batteries. The Ministry's facebook page states that the regulations were imposed in response to about 26 cases / incidents related to primary batteries claimed to be 'counterfeits'? 

Standards Users toy regulations and MC mark implementation study shows that the MC mark and the process of obtaining the mark and mark design makes it easily faked! 

How will then, using the similar labeling approach makes primary batteries any safer then they are now. IF MC marks are easily forged and if consumers cannot distinguish between a fake and original label, how will they know what they are buying? More importantly how will they know if what they buy is actually safe?

Calling the KPDNKK or visiting thier website for information is not an option. In many cases the response using the e-aduan channel is rather slow.

KPDNKK should allow consumers to check status of product registered to be safe and other relevant information. Otherwise consumers will not be 'EMPOWERED' to protect themselves - like KPDNKK wants consumers to be


Why exclude lap top or mobile phone battery packs? 

KPDNKK needs to review the implementation of the safety mark, toy safety and the current battery safety regulations.
